Key benefits

Identification of affected land parcels

The complete and structured identification of all affected third-party land parcels helps reduce legal risks over the long term.

Land register database

The centralised, structured recording of easements replaces disparate lists and provides immediate visibility.

Modular and flexible

Available as individual modules or as a complete package, enabling flexible collaboration without fixed project or resource commitments.

Recording and updating utility line rights on third-party land

In the context of public utility networks for electricity, sewerage, water and gas, a utility line right is a right in rem held by a utility or waste management company, allowing it to install and operate utility lines on land owned by a third party.

Installing infrastructure such as power cables, pipelines, district heating pipes and sewers often involves crossing third-party land, particularly on the last mile. Companies that do not own the land concerned require the consent of the relevant landowners before they can install and operate utility lines there.

Under German land registration law, this consent is formalised through a utility line right in the form of an easement or a restricted personal easement. The right must be entered in the land register.

Recording and continuously updating all rights registered in the land register for properties not owned by grid operators is a demanding and highly labour-intensive task.

We support municipal utilities and inter-municipal bodies with baseline data collection, statistical analysis and keeping their datasets up to date.

We can provide the work described as a complete package or as individual service modules. Together, we agree how responsibilities should be divided between your organisation and CAIGOS as your service partner.

How we support you

The task

Identifying all land parcels crossed by utility infrastructure, including sewers and water, gas and electricity lines, that are not owned by the utility operator.

Our solution
  • Identification of all land parcels that are not owned by the utility but are crossed by lines forming part of its network.
  • Utility line rights that must be entered in the land register, in the form of restricted personal easements, are systematically recorded in the land register database. The data collected can support the case-by-case review of third-party ownership rights.
  • Affected properties are determined using ownership and land-use criteria. Ownership criteria include privately owned properties, irrespective of use; properties owned by the federal government, a federal state, a district or another municipality; and any other properties not owned by the municipality or utility. All types of land use are included except public road and traffic areas.
The outcome
  • Ready access to all rights held by utility and waste management operators over land parcels they do not own, generally restricted personal easements, through a database-backed specialist application for managing rights registered in the land register
  • A data foundation that can be kept up to date and used to process the required entries in the land register
  • Confidence in the completeness of the recorded data
  • Largely automated updates to the recorded information following changes to cadastral data
